PARTICIPATION AGREEMENT

This is an agreement between:

WORLD GYM BUNDABERG

(PHOENIX HEALTH CLUBS PTY LTD – ABN 60 656 282 307)

I certify that I have read the entirety of this Participation Agreement, understand its terms, and agree to abide by them for the duration of my participation in sparring sessions at World Gym Bundaberg. I acknowledge that I have received a true copy of this Agreement.

1. WARRANTY AND REPRESENTATIONS OF PARTICIPANT

The Participant represents and warrants the following:

a. They are in good health, free from any condition that would prevent safe participation, and consult with a physician regularly.

b. They understand sparring and physical training carry inherent risks of personal injury.

c. They will obey all rules, regulations, and directions of trainers and staff.

d. They will participate within their physical limitations and conduct themselves responsibly.

e. They have read and fully understand this agreement.

f. They acknowledge sole responsibility for assessing their fitness and readiness to spar.

2. WAIVER OF LIABILITY AND DISCLAIMER

The Participant agrees and acknowledges:

a. Participation in sparring sessions is voluntary and at their own risk.

b. World Gym Bundaberg does not provide insurance for personal injury or property damage.

c. The Participant assumes full responsibility for any injury or loss incurred during sparring sessions.

d. The Participant fully releases and holds harmless World Gym Bundaberg, its shareholders, directors, officers, employees, volunteers, agents, the landlord of the premises, and any affiliated parties from any liability for injury, property damage, or loss arising from participation.

e. World Gym Bundaberg is not responsible for theft, loss, or damage to personal property.

f. The Participant agrees not to bring any legal claim or demand against any party released in clause (d).

g. The Participant agrees not to support, assist, or join others in bringing claims against any party listed in clause (d).

h. This waiver and release may be used as a complete defence and bar to any action brought by or on behalf of the Participant.

i. The Participant agrees to indemnify World Gym Bundaberg, its employees, officers, volunteers, and agents from any third-party claims caused by their own negligence or intentional acts.

3. GENERAL GYM RULES FOR SPARRING

Participants must adhere to all gym and sparring rules, including but not limited to:

• No participation under the influence of alcohol or drugs.
• No harassment, bullying, or intimidation of any kind.
• Use of protective equipment including:
• Headgear
• Mouthguard
• Groin guard
• 16oz gloves
• Hand wraps
• Suitable footwear
• Participants must undergo a pre-sparring medical check if required by staff.
• Participants must obey all instructions from gym staff, coaches, referees, and medical personnel.

Violation of these rules may result in immediate suspension or termination of sparring privileges.

4. GOVERNING LAW & ELECTRONIC ACCEPTANCE

This Agreement is governed by the laws of Queensland, Australia. If any clause is found invalid, the remaining provisions will remain in effect. This Agreement may be executed electronically, and electronic signatures shall be deemed valid and binding.
