BODY SHOT BOXING AGREEMENT
Welcome to the Bodyshot Boxing Club family. We are excited to get you started on your fitness journey.
In order to get you underway, please complete the forms required, including medical, rules, terms & conditions and select your payment frequency.
Our Bodyshot Boxing Club membership is NO CONTRACT with NO JOINING FEES but does require 30 days’ notice to cancel your membership, of which, during this time, can be used like normal. Your Bodyshot Boxing Club membership provides you access to the gym during opening hours and all classes within your membership level.
*Please note that, on joining Bodyshot Boxing Club and becoming a member, you must also complete all induction requirements as requested by World Gym Burpengary. To be a member of Bodyshot Boxing Club it is a condition you must also become a member of World Gym Burpengary, under which Bodyshot Boxing Club is contracted. World Gym Burpengary will also provide unlimited 24-hour access at a special corporate rate discount price (for BSBC members only) as per agreed by World Gym Burpengary membership terms & agreements. To receive this membership discounted rate, you must provide your BSBC member card and photo identification to staff of World Gym Burpengary prior to completing all necessary “sign up” forms & documentation required by World Gym Burpengary. All terms & conditions of World Gym Burpengary membership must also be adhered to, in conjunction with Bodyshot Boxing Club.

If you are not a member of World Gym Burpengary you will also need to obtain a gym trial or membership after completing this form.

For boxing and sparring, all participants over 40 years of age must have a medical certificate provided, at their cost, certifying that such participant is physically capable to safely undertake the dangerous recreational activity of boxing and sparring.
MINORS/CHILDREN- children who are 12-14 years of age (inclusive) may become members and have access whilst they are fully supervised by a personal trainer and/ or a parent or legal guardian.
Children 15 years of age or older can join as a member (with authorisation of parent or guardian) but may have restricted access to some facilities or services.
Children 5-12 years of age (inclusive) will NOT require joining as a member of World Gym Burpengary, but it is required to pay fees to train with Bodyshot Boxing Club. All necessary membership forms are to be completed by the parent or guardian for both World Gym Burpengary and also Bodyshot Boxing Club upon joining. Parent/ guardian must remain on the premises whilst children (5-12 years) are training at all times.
Equipment: For the safety of you and others, please follow all equipment operating and safety instructions on the equipment. If you are unsure of correct use, or operation of equipment, please seek assistance from a Bodyshot Boxing team member, or World Gym Burpengary staff. For the functional training equipment, please seek assistance and/or advice from a personal trainer, either from Bodyshot Boxing Club or World Gym Burpengary, if you are unfamiliar with the equipment or its safe and appropriate use.

As children and young people who are part of Bodyshot Boxing Club we agree that:
• We will respect other children, young people and adults
• We will cooperate and play by the rules
• We will listen and receive instructions
• We will control our temper
• We will have a say about what we are involved in
• We will speak up if we are worried or concerned about something
• We will not be a bully or accept any bullying that we see
Code of Conduct for Coaches of Bodyshot Boxing Club
As a coach for Bodyshot Boxing Club, I will:
• Respect the right, dignity and worth of every person, regardless of their abilities, gender, religion or cultural background
• Support all efforts to remove any form of abuse in this organisation and encourage a safe and supportive service environment
• Ensure that any physical contact with others is appropriate to the situation and necessary for the person’s skill development
• Refrain from developing close personal relationships with children and young people outside of the coach/participant relationship
• Refrain from using abusive, derogatory or offensive language
• Impart knowledge and skills of the game in a respectful and encouraging manner. Respect the decisions of the staff/officials and encourage participants to do the same. Always consider the health, safety and welfare of the participant
• Not show favouritism towards talented individuals
Code of Conduct for Parents and Carers
As a parent/carer of a child involved in the service provided by Bodyshot Boxing Club, I agree that:
• I will respect the rights, dignity and worth of every person, regardless of their abilities, gender, religion or cultural background
• I will respect the decisions of employees/officials and teach children to do likewise
• I will focus on and encourage children’s efforts and performance
• I will support all efforts to remove any form of abuse in this organisation and encourage a safe and supportive service environment
• I will remember that my child participates in activities for their own enjoyment, not mine
• I will raise any issues or concerns with staff
• I will not treat any child or young person in an unfair, unjust or discriminatory manner
• I will not smoke on the organisation’s premises
• I will not drink alcohol or use illicit substances while on the organisation’s premises
Conduct
□ I have read and understand the Bodyshot Boxing Club Code of Conduct and acknowledge that misconduct may lead to suspension or cancellation of membership in, and access to Bodyshot Boxing Club.
Privacy
□ I have read and understand the Bodyshot Boxing Club Privacy Policy.
Waiver
□ I have read, understood, acknowledge and agree to consent to all terms of this waiver, including the warning, exclusion of implied terms, release and indemnity which has been explained clearly to me by Bodyshot Boxing Club. I authorise and consent to undertaking all activities run by Bodyshot Boxing, at my own risk, at all times.
Photography/Videography
□ I understand that Bodyshot Boxing Club may use my, or my child or ward’s photographic image and /or voice and/or word (all known as ‘digital resource’) for publicity and promotional purposes in all forms of media including without limitation on TV, radio, press, magazine, outdoor, direct mail, PR, posters, corporate video, cinema, Internet (worldwide) subscription, social media and literature, and assign any and all rights, title and interest in the digital resource to which I or my child or ward may be entitled in law, to, Bodyshot Boxing Club and agree to make no claim for compensation for the use of the resources including digital resources.
If you do not give consent for the above, please ensure you inform the Club when you make payment.
Authorisation
□ I authorise Bodyshot Boxing Club to obtain all necessary medical treatment which may be required by me (or my child or ward) whilst in the care, control or custody of Bodyshot Boxing Club including any anaesthetic or surgical attention, which may be prescribed by an appropriately qualified medical practitioner, I acknowledge that the costs of any such treatment, including ambulance fees, will be my responsibility.
□ I authorise Bodyshot Boxing Club to exercise all reasonable control, necessary in the circumstances over me (or my child or ward) or over my (or my child’s or ward’s) behaviour whilst in the care, control or custody of Bodyshot Boxing Club.
□ I am fully aware of the range of activities run by Bodyshot Boxing Club and consent to my child or ward’s participation in any activities run by Bodyshot Boxing Club, or its agents.
Participation
□ I understand that participation in Bodyshot Boxing Club activities involves the risk of injury and/or loss and damage to my property and that I participate in Bodyshot Boxing Club activities at my own risk.
□ I am aware and understand that Bodyshot Boxing Club, its staff, management, volunteers or agents are not liable for any personal injury, loss or damage of property or expenses, including medical expenses, which I or my child or ward may suffer at the Club and/or as a result of a Bodyshot Boxing Club activity.
□ I acknowledge that I have provided medical information on this form for emergency purposes only, and that Bodyshot Boxing Club is not liable for failing to use this information in any circumstances.
Family Definition*
As defined by the ABS as two or more persons, one of whom is at least 15 years of age, who are related by blood, marriage (registered or de facto), adoption, step or fostering, and who are usually resident in the same household.

INJURY WAIVER AND RELEASE OF LIABILITY FORM
I HEREBY ASSUME ALL THE RISKS OF PARTICIPATING IN BOXING (hereinafter program) OR ANY OTHER FORM OF PHYSICAL ACTIVITY offered by Bodyshot Boxing Club including by way of example and not limitation, any risks that may arise from negligence or carelessness on the part of the persons or entities being released, from dangerous or defective equipment or property owned, maintained, or controlled by them, or because of their possible liability without fault.
I CERTIFY that I am physically fit, have sufficiently prepared or trained for participation in the programs, activities or events offered by Bodyshot Boxing Club, and have not been advised to not participate by a qualified medical professional. I certify that there are no health-related reasons or problems which preclude my participation in these programs, activities, or events onsite / offsite Bodyshot Boxing Club premises.
I ACKNOWLEDGE that this Injury Waiver and Release of Liability Form will be used by Bodyshot Boxing Club, its program instructors, and their affiliates, and that it will govern my actions and responsibilities at said programs, activities, or events.
IN CONSIDERATION of my agreement with Bodyshot Boxing Club, and permitting me to participate in these programs, I hereby take action for myself, my executors, administrators, heirs, next of kin, successors, and assigns as follows:
(A) I WAIVER, RELEASE AND DISCHARGE from any and all liability, including but not limited to, liability arising from the negligence or fault of the entities or persons released, for my death, disability, personal injury, property damage, property theft, or actions of any kind which may hereafter occur to me including my traveling to and from any Bodyshot Boxing Club, activity, or event, THE FOLLOWING ENTITIES OR PERSONS: Bodyshot Boxing Club and/or its directors, officers, employees, volunteers, representatives, and agents, the program instructors, activity or event holders, activity or event sponsors, activity or event volunteers:
(B) I INDEMNIFY, HOLD HARMLESS, AND PROMISE NOT TO SUE the entities or persons mentioned in this paragraph from any and all liabilities or claims made as a result of participation in these programs, activities, or events, whether caused by the negligence of release or otherwise.
I ACKNOWLEDGE that Bodyshot Boxing Club and its directors, officers, volunteers, representatives, and agents are NOT responsible for the errors, omissions, acts, or failures to act of any party or entity conducting a specific program, activity, or event on behalf of Bodyshot Boxing Club.
I ACKNOWLEDGE that these programs, activities and events may involve a test of a person‘s physical and mental limits and may carry with it the potential for death and serious injury. The risks may include, but are not limited to, those caused by facilities, temperature, condition of participant, equipment, actions of other people including, but not limited to, participants, volunteers, spectators, coaches, event officials, and event monitors, and/or producers of events, and lack of hydration.
I HEREBY ACKNOWLEDGE that I am fully required to provide my own medical coverage and that Bodyshot Boxing Club will not be held liable for any expenses incurred for treatment of injuries while participating in these programs, activities, or events.
The injury waiver and release of liability shall be construed broadly to provide a release and waiver to the maximum extent permissible under applicable law.
I CERTIFY THAT I HAVE READ THIS DOCUMENT, AND I FULLY UNDERSTAND ITS CONTENT. I AM AWARE THAT THIS IS A RELEASE OF LIABILITY AND A CONTRACT AND I SIGN OF MY OWN FREE WILL.
PARENT / GUARDIAN WAIVER FOR MINORS (Under 18 years of age)
The undersigned parent and natural guardian does hereby represent that he/she is, in fact, acting such capacity, has consented to his/her child or ward‘s participation in the programs, activity or events, and has agreed individually and on behalf of the child or ward, to the terms of the injury waiver and release of liability set forth above. The undersigned parent or guardian further agrees to save and hold harmless and indemnify each and all of the parties referred to above from all liability, loss, cost, claim, or damage whatsoever which may be imposed upon said parties because of any defect in or lack of such capacity to so act and release said parties on behalf of the minor and the parents or legal guardian.
In the course of establishing a contract with you and during the term of that contract we will obtain access to certain sections of your personal information (such as information concerning your health and your financial position).
Bodyshot Boxing Club will only use, disclose or deal with such information in accordance with our privacy policy. A full copy of our privacy policy is available to you at any time and can be sent to you on request in writing to bodyshotboxing@outlook.com or handed to you in person, if this is preferred.

What is personal information and why do we collect it?
Personal information is information or an opinion that identifies an individual. Examples of personal information we collect include: names, addresses, email addresses, phone and facsimile numbers.
This personal information is obtained in many ways including correspondence, by telephone, email, via our social media platforms, from media and publications, from other publicly available sources, from cookies and from third parties. We don’t guarantee website links or policy of authorised third parties.
We collect your personal information for the primary purpose of providing our services to you, providing information to our clients and marketing. We may also use your personal information for secondary purposes closely related to the primary purpose, in circumstances where you would reasonably expect such use or disclosure. You may unsubscribe from our mailing/marketing lists at any time by contacting us in writing.

Bodyshot Boxing Club will not charge any fee for your access request but may charge an administrative fee for providing a copy of your personal information.
In order to protect your personal information, we may require identification from you before releasing the requested information.
Maintaining the Quality of your Personal Information
It is important to us that your personal information is up to date. We will take reasonable steps to make sure that your personal information is accurate, complete and up to date. If you find that the information we have is not up to date or is inaccurate, please advise is as soon as practicable so we can update our records and ensure we can continue to provide quality services to you.

Staff, Supported Employees & Participants
Body Shot Boxing Club regularly conducts marketing and communication activities to build a positive profile and brand in the community. While these activities are beneficial for the organisation and are of interest to the community, ensuring the safety of staff, supported employees and participants is paramount in all that we do.
The Privacy Amendment Act 2001 imposes obligations on organisations that collect personal information to protect that information. Images of people in photographs or film are treated as personal information under the Privacy Act, where the person’s identity is clear or can be reasonably identified. Photos, video footage and work samples are used regularly by Body Shot Boxing Club for a number of purposes. These situations are with the purpose of acknowledging the efforts of someone or for promoting the organisation to wider audiences.
CONSENT
I consent to being identified by image or name for marketing and promotional purposes by completing and signing this Media Consent Form.
I give permission for photos, video, audio and samples of work created or contributed to, for the use of marketing, media activities and publications. This may include use in print collateral and online via our website or social media.
PURPOSE
Consent applies to any use, copy, or disclosure of the individual’s name, recording, image, individual work and personal information, including but not limited to:
• Any activities/events engaged in at or for Body Shot Boxing Club
• For PR, marketing, media or advertising opportunities
• Use by external media in relation to activities that positively showcase someone or a project
REMUNERATION
I will not be entitled to remuneration by giving consent to take part in Body Shot Boxing Club marketing or promotional activities.
COPYRIGHT
Ownership of any material obtained from Body Shot Boxing Club, will remain the property of Body Shot Boxing Club.
DURATION
I acknowledge that the material may continue to be used for an extended period of time, even after I have left Body Shot Boxing Club. I Understand that some of the marketing channels in which the material is used may have extended longevity and, in some instances, irrevocable. If I wish to revoke or modify my consent in relation to any future use of personal information or photography, I am required to send a notice in writing to the Manager or Secretary.
PRESCREENING
Please complete the following medical check which has been designed as a pre-exercise/ training tool, which will assist us to determine what level of exercise you are ready for. By answering the questions as accurately as possible, this will assist us to establish any considerations we may need to make your training experience as safe and enjoyable as possible. All information recorded remains confidential.
Please answer the following questions and provide any additional details where applicable.
- *In the event of any pre-existing health problems such as fractures, heart conditions, epilepsy, spinal issues, head injuries, or any other problematic condition, not mentioned here; the participant must obtain a medical certificate from an appropriately qualified medical practitioner confirming that it is safe for the participant to engage in rigorous training activities.
-I have read and understood the questions in this form and I have answered the questions honestly and to the best of my knowledge and ability.
-Any participation in physical activity is not without risks or dangers and my participation is voluntary and informed
-I have not failed to disclose any medical conditions that a suitably qualified medical practitioner would consider may render me unsuitable for rigorous physical activity.
-I declare that I am medically and physically fit and able to participate in the boxing and fitness, sporting and training activities as required by me. I will immediately notify Bodyshot Boxing Club, in writing of any change to my medical condition, fitness, or ability to participate. I understand and accept that Bodyshot Boxing Club will continue to rely upon this document as evidence of my fitness and ability to participate.
-I undertake to release to the full extent of the law Dwayne Tindall trading as Bodyshot Boxing Club along with all employees/agents from all claims, demands, and proceedings whatsoever with respect to any accident, incident, loss or injury.
